Agreement to Terms and Conditions

 

This website is owned and operated by Dynamic Flight.  These Terms set forth the terms and conditions under which you may use our website and services as offered by us.  By using this website (www.dynamicflight.com.au) you approve that you have read, understood and agree to be bound by these Terms.

 

Identification

To use our website, you must be at least 18 years of age, or if under 18 years have the consent and/or guidance of your parent/guardian, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement.  

 

Purchasing

When purchasing an item, you agree that

  1. You are responsible for obtaining full item information before making a commitment to buy it;

  2. You are entering into a legally binding contract to purchase an item when you commit to buy an item and complete the payment process

The prices we charge are available on our website and can be confirmed via email (rohan@dynamicflight.com.au) prior to payment.  We reserve the right to change our prices for products at any time, and to correct pricing errors that may inadvertently occur.

 

Returns and refunds

Australian Consumer Law applies to our goods sold in Australia.  You are entitled to a replacement or refund if any major defect or damage during manufacture of our products is detected upon delivery.  You are entitled to have the goods repairs or replaced if the goods fail to be of acceptable quality and the failure does not amount to a failure through operator error.  A refund is not offered if you simply change your mind or make a wrong decision.

 

Retention of right to change offering

We reserve the right to change the services, stop providing services or create limits for our services.  We may temporarily or permanently terminate services without notice for any reason, or for no reason.

 

Warranties

Warranties on services or products are limited to the original purchaser only.  This warranty shall be effective from the date of purchase via our website or in person from Dynamic Flight.  Our warranty policy applies to items manufactured or serviced by Dynamic Flight and sold in Australia, where permitted by law, to consumers as defined in the Australian Consumer Law.  Claims can only be made under warranty by the person who originally purchased the product or service.  The warranty applies for a period of 12 month from the date of sale, Dynamic Flight will replace or repair any defective product without charge.  This is subject to and providing the damage does not arise from or relate to –

  • Improper adjustment or operation by the consumer

  • The use of accessories not approved by Dynamic Flight

  • Any modifications to the product which were not authorised in writing by Dynamic Flight

  • Any misuse of the product by the consumer or anyone for whom the consumer has legal responsibility (including a minor)

  • Normal wear and tear

  • Heat or weather damage

  • Damage from transportation or storage

  • Damage caused by alterations or modifications of the products not authorised in writing by Dynamic Flight

  • Damage caused to products used for promotional, commercial, rental or demonstration purposes.  Demo or used equipment is not covered under warranty

  • Any use or operation of the products outside of the physical specification of the product; or

  • Inadequate or improper maintenance of the product

 

Ownership of intellectual property, copyright & logos

You recognise and agree that you shall not sell, license, rent, modify, distribute, copy, reproduce, transmit, publish, adapt, edit or create derivative works without the express written consent of Dynamic Flight.  This website (www.dynamicflight.com.au) is covered by copyright law.

 

Indemnity

You agree to indemnify and hold Dynamic Flight harmless for any demands, loss, liability, claims or expenses (including attorney fees), made against them by any third party due to, or arising out of, or in connection with your use of the website (www.dynamicflight.com.au) or any of the services offered on the website.

 

Limitation of liability

To the maximum extent permitted by applicable law, Dynamic Flight assumes no liability or responsibility for any;

  • Errors, mistakes or inaccuracies of content

  • Personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and

  • Any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.

 

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion.  You should review these pages periodically.  Your continued use of the website (www.dynamicflight.com.au) constitutes your acceptance of the new Terms.  If you do not agree to any of the terms or any future versions of the Terms, do not use or continue to use the website.

 

Promotional content

You agree to receive promotion material from us from time to time by mail, email or any other contact you may provide us with (including your phone number for calls or text messages).  If you don’t want to receive promotional materials or notices please notify us –
